Former Wakefield resident facing 100 child sex charges in Middlesex County also has case in Essex County after accuser came forward.
Accused child molester John Burbine has pleaded not guilty to charges of rape of a child and indecent assault and battery on a child under 14 in Essex County. During a Wednesday, May 1 a not guilty plea was entered on Burbine's behalf in Salem Superior Court and he was ordered held without bail. These charges were filed after a male accuser came forward with allegations against Burbine shortly after learning of his arrest late last year. He has been held at the Billerica House of Correction since around that time. A spokeswoman for the Essex County District Attorney's office told Wakefield Patch that the new accuser is a male and that his allegations against Burbine cover a four-year span dating back to the early 1990s. John Burbine's attorney has asked a judge to dismiss eight of the 100 charges filed against him.
The lawyer for accused child molester John Burbine has asked a judge to dismiss eight of the 100 charges his client is facing, saying his own client reached a "level of deviancy and perversion" unanticipated by the law, given the very young age of the victims. Attorney Bill Barabino has filed a motion to dismiss six counts of aggravated rape of a child and two counts of dissemination of matter harmful to minors. If the motion is granted, Burbine would face 92 remaining counts. Burbine's wife, Marian, faces additional charges of reckless endangerment of a child for operating an illegal day care center in Wakefield where many of the victims' families were clients. Facing 100 charges involving child sex abuse in Middlesex County, a Saugus boy alleges Burbine abused him.
Accused serial child sex abuser John Burbine is now reportedly facing additional charges in Essex County. According to a Salem News report, an Essex County grand jury has indicted Burbine on charges of indecent assault and battery and child rape. The new accuser, a boy from Saugus, has has alleged Burbine abused him between May 1990 and January 1994. The incidents occurred in Saugus. The accuser reportedly came forward after seeing the initial media coverage in the case. The Essex County District Attorney's Office and Saugus Police investigated the allegations, according to the Salem News. An arraignment date has not yet been set on the new charges. The wife of accused child molester John Burbine made a court appearance on Wednesday, March 20.
The trial of Marian Burbine, the wife of accused serial child molester John Burbine, is not expected to start on Aug. 9. Appearing with his client at a Wednesday, March 20 hearing at Middlesex Superior Court, attorney John Ruehrwein told the court that he was seeking additional time because of the large amount of evidence associated with the case. The previous trial date for Marian Burbine had been June 25th. At least one of John Burbine's alleged victims is fom Waltham. Marian Burbine is due back in court on April 25 for an evidence suppression hearing. A pre-trial conference hearing is set for July 30. Marian Burbine, who is accused of running an illegal day care with her husband John Burbine, will appear in Middlesex Superior Court in Woburn on Thursday, March 21 for a pre-trial conference. If a new bill becomes law, you will be able to go to your local police station to find out who are the convicted sex offenders who live in your area. The legislation would not only make additional information on Level 1 sex offenders available to the public, but also would automatically classify anyone convicted of a sex offense against a child as a Level 2 offender. Marian Burbine made a short court appearance on Thursday morning, largely to set the terms of her ongoing home confinement in connection with the child sex abuse case against her husband. Mrs. Burbine and her husband operated the former Waterfall Education Center in downtown Wakefield, and also offered tutoring and daycare services that would reportedly often take place at the children's homes. Her husband had been classified a Level 1 sex offender back in 1989, which has touched off a separate legislative debate over how to reform the current system used to share information on sex offenders. John Burbine pleaded not guilty to 100 child sex abuse charges at his arraignment Wednesday morning in Middlesex Superior Court in Woburn. The Wakefield man was arrested earlier this year and charged with numerous abuse violations involving children primarily under the age of 3. At least one of his victims is from Waltham. Burbine spent much of the hearing looking straight ahead behind glass in a separate room, answering questions primarily with one-word responses. A Wakefield husband and wife are facing numerous charges in connection with an illegal day care service that subjected at least 13 children - one of them just days old - to horrific sexual abuse that was recorded on video. On Thursday, Middlesex District Attorney Gerry Leone announced the indictments of Wakefield residents John Burnbine, 49, and his wife, Marian Burbine, 46.
