The woman accused of running over and killing and Waltham man is in the process of being deported, according to federal immigration officials.
The Middlesex County District Attorney, however, has asked federal Immigration and Customs Enforcement officials to keep 29-year-old Blanca Contreras in the country to stand trial for motor vehicle homicide.
“I can confirm for you that she is currently in ICE custody and in removal proceedings,” ICE spokesman Ross Feinstein told Waltham Patch in an email.
DA spokesman Jessica Pastore told Waltham Patch last week that her office had asked ICE to keep Contreras, a native of Guatemala who is in the United States illegally, in the country to faces charges of motor vehicle homicide.
Feinstein told Patch, in a phone interview, that Contreras must go through the normal removal proceedings, including a hearing before a judge that could order her removed.
Contreras was released on Dec. 20 after a relative posted her $50,000 bail, according to Waltham District Court records.
Contreras is scheduled for a Jan. 26 pre-trial hearing at Waltham District Court.
