MBTA to Fire Drivers for Carrying Cell Phones After Newton Bus Crash

Drivers will be disciplined even if they aren't using cell phones or electronic devices.

The Massachusetts Bay Transportation Authority says it will fire bus or train operators who are carrying a cellphone or other electronic devices while on duty, even if they aren't using the devices, the Boston Herald reported Monday

A previous policy called for 10-day suspensions against drivers who possess cell phones and automatic dismissal if the device was used, but the new policy would result in the suspension of said operator for 30 days and come with a recommendation that they be fired, according to the report. 

The move comes less than a month following the firing of an MBTA bus driver who drove off an overpass in Newton, which injured eight riders, including the driver, who was allegedly using a cell phone at the time of the incident.

Wasn't this always the rule after that rear end years back? Or was it just a slap on the wrist.

I think this is a violation of constitutional rights. Having a phone in your pocket is a persons right. They should have to prove it was being used to be able to fire a person. It really isn't much different then driving with a case of beer in your backseat. Consider FedEx and UPS they communicate to their dispatch through scanners. You can regularly see them doing it while they drive.

If it were up to me banks, restaurants, movie theaters, sporting venues would have jammers......

Cell phones kill. MA, which is a highly regulated state, made a HUGE mistake allowing adult drivers to use cell phones in cars. In NYS it is strictly forbidden to be holding a cell phone while driving. Why not in MA? People are insane about their phones. The roads are hideously unsafe.
