UPDATED: Hingham Man Charged In Waltham Attack Pleads Not Guilty, Released On Bail

Accused's mother denies, says full story not yet revealed.

 

A Hingham man charged with attacking two people in Waltham last week has been released on $2,000 cash bail after a dangerousness hearing yesterday.

Timothy A. Schmitt, 22, pleaded not guilty to two counts of aggravated assault and battery, assault and battery with a dangerous weapon, trespassing and a civil rights violation with injury during his Friday, April 8 arraignment at Waltham District Court, according to Middlesex District Attorney spokesman Cara O’Brien. He also pleaded not guilty to a charge of assault to intimidate.

Yesterday, Schmitt made bail but must follow several conditions ordered by a judge, according to court records. He must have no contact with the victims, and remain in the custody of his mother and under house arrest, O’Brien said. Schmitt, however, would be allowed to leave his home for classes, appointments with his attorney or doctor, and must remain in school. He would also have to check in with the state Probation Department twice weekly.

Schmitt is scheduled for another court hearing on Tuesday, May 17, according to Schmitt’s mother.

In accordance with policy, Schmitt has been suspended from Bentley University, according to spokesman Michele Walsh.

Schmitt’s mother, Mary Anne Schmitt, defended her son, saying the full story of the incident has not been revealed. Reached by Patch, Schmitt read a statement.

“Regrettably, [Tim] was involved in an off-campus altercation last week that resulted in criminal charges. While Tim and his family cannot discuss the details of the incident at this time, we do wish to state that the charges, police report and media accounts represent only one side of the story. Tim was not the instigator and he specifically denies the allegations that the incident was racially motivated on his part or that he used any racial slurs, period.”

She continued: “If the case progresses further in the court system, we are confident that the evidence will show that what has been reported to date is not the full story or anything close to the truth.”

She added that her son is a Dean’s List student at Bentley, studies finance, and was an honor roll student at Hingham High School.

The charges stem from a Friday, April 8 incident on the Waltham City Common. Police allege Schmitt attacked two individuals, including a pregnant woman, and used racial slurs toward them. 

The incident left a male victim, an African American, with facial lacerations and a broken skull bone. The woman declined medical assistance.
