Feds File Lawsuit Against Waltham Contracting Company

R.J. Cincotta allegedly failed to pay penalties for violating mining rules.

 

The federal government has sued a Waltham company for unpaid penalties, according to the U.S. Department of Labor. 

The DOL on July 12 filed a lawsuit against R.J. Cincoctta company for not paying in $144,847 (plus interest) penalties incurred for alelgedly violating mining regulations, according to the DOL.

The DOL is also seeking an injunction and money to guaranttee future penalties will be paid. Two other firms, one in Connecticut and the other in New Hampshire, are named in the suit.

"Over a period of several years, these employers either reneged on promises to pay these penalties or they failed to contest them and then chose to ignore them. Mine operators cannot be permitted to violate mine safety laws and simply refuse to pay the penalties assessed for those violations," said Regional Solicitior of Labor for New England Michael Felsen in a statement. "The Department of Labor will use all the tools available, including litigation in federal court, to pursue these scofflaws."
